§ 10-91. Definitions; applicability.

  • (a)

    For the purposes of this article, the term used herein is defined as follows:

    Hazardous materials: A substance or material which has been determined by the U.S. Secretary of Transportation to be capable of posing an unreasonable risk to health, safety and property when manufactured, stored or transported in commerce and which has been so designated.

    (b)

    This article shall apply to materials not otherwise covered in this Code which are highly flammable, or which may react to cause fires or explosions, or which by their presence create or augment a health, fire or explosion hazard, or which because of their toxicity, flammability, or liability to explosion render fire-fighting abnormally dangerous or difficult; also to flammable or combustible liquids which are chemically unstable and which may spontaneously form explosive compounds, or undergo spontaneous reactions of explosive violence or with sufficient evolution of heat to be a fire hazard. Hazardous chemicals, oxidizing materials, potentially explosive chemicals, highly toxic materials and poisonous gases are defined in the National Fire Protection Manuals.
